FLEGT.org terms and conditions
1. Acceptance of terms and conditions
By creating an account at FLEGT.org (the Portal) or otherwise accessing the Portal, you agree to be bound by these terms and conditions. The European Forest Institute (EFI) may change these terms and conditions at any time without notice to you. By continuing to access the Portal following any change, you accept and agree to be bound by all changes.
Activities or misrepresentation by you contrary to this agreement will lead to suspension or deletion of your account. EFI may also delete your account at its own discretion.
2. The Portal
The Portal is intended to improve the management of the wealth of information and knowledge materials which have been developed about Forest Law Enforcement, Governance and Trade (FLEGT) and to make these materials more easily accessible to those who are working on FLEGT, or to those who could potentially contribute to FLEGT.
EFI takes no responsibility for content on the Portal, including but not limited to its accuracy, availability, completeness, fitness for purpose, non-infringement or reliability.
The use of the Portal and the use of information received through the Portal is at your own risk. Under no circumstances shall EFI be liable for any loss, damage, liability or expense incurred or suffered from the use of the Portal. Under no circumstances, including but not limited to negligence, shall EFI be liable for any direct, indirect, incidental, special or consequential damages.
The Portal, as well as content on the Portal, may be added, changed, improved, discontinued or updated without notice.
You certify that you are at least 16 years of age. If you are under 16 years of age you may not under any circumstance or for any reason create an account on the Portal.
When creating an account (which is required for you to access some parts of the Portal) you may not provide any false personal information, or create an account for anyone other than yourself. You may not create more than one account.
A profile may be created for an organisation provided that the user is authorised to do so by the organisation.
All account information must be accurate and up-to-date.
You must not do anything that might jeopardise the security of the account or the Portal, including sharing your password with others or allowing someone else to access your account.
EFI may remove a username or assign a new username to a user if EFI deems it to be inappropriate (this can for example be if a trademark owner complains about a username that does not closely relate to a user's actual name).
You can choose to delete your account. You acknowledge that deleting your account will not result in the deletion of content that you have added to the Portal.
All content added, uploaded, submitted, distributed, posted to, created, or through any similar action made available by you in using the Portal (User content) is your sole responsibility. You certify that all User content is accurate, complete and in compliance with all applicable laws, rules and regulations. You understand and acknowledge that other users can access the content and that the content will be associated with you.
EFI may access, read, edit, store, remove, publish, transmit, display and disclose User content without notifying you.
You acknowledge that postings and any other form of communication may not be endorsed by EFI and cannot be considered as having been reviewed, screened or approved by EFI. You confirm and agree that EFI is not liable for any conduct of any user of the Portal.
You may not post spam, access the Portal or collect the content of other users or information using automated means, upload viruses or other malicious code, solicit login information or access an account belonging to someone else, use the Portal to do anything unlawful, misleading, malicious, or discriminatory, do anything that could disable, overburden, or impair the proper working of the Portal, or facilitate or encourage any violations of these terms and conditions.
You may not use the Portal or content on the Portal in any way that infringes anyone's intellectual property rights. You therefore have to be aware of copyrights, trademarks, patents and other proprietary rights and laws that may apply to specific material within the Portal.
By adding, uploading, submitting, distributing, posting to, creating, or making available User content through any similar action you grant EFI a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use that User content.
You may not delete any attributions, legal notices, proprietary designations or labels from any content on the Portal nor falsify the origin or source of software or other material.
5. Third party links
The Portal may contain links and references to third-party websites. These are provided for the users' convenience and interest. For EFI, this implies neither responsibility for, nor approval of, information contained in these websites.
6. Information collected and used
The following information about users is stored on EFI servers:
- Basic account information: name, username, password, email address, phone number, organisation, summary, date of birth, city, country, profile image, header image, links, job title, role
- Postings: your messages and the metadata associated with your messages such as your images, videos, lists created and users followed on the social wall
- Log data: IP address, browser type, operating system, pages visited, location, device information and search terms
The information will be stored and analysed in order to provide you with a better experience when using the Portal and to match content with users.
The information will be stored as long as required to fulfil this purpose.
The information may be disclosed by EFI to comply with any applicable law or regulation, enforce these terms and conditions, detect and address technical or security-related matters, or respond to requests for support.
You agree to indemnify EFI from and against any and all actions, claims, losses, damages, liabilities and expenses (including reasonable attorneys' fees) arising from your use of the Portal.
8. Governing law and jurisdiction
These terms and conditions shall be governed by Finnish law, excluding its rules on conflict of laws. Any dispute, controversy or claim arising out of, or relating to, these terms and conditions shall be finally settled in accordance with the Arbitration Rules of the Finland Chamber of Commerce. Article 36 on Interim measures of protection shall not apply. The language of the proceedings shall be English. The place of arbitration shall be Helsinki, Finland.
9. Preservation of privileges and immunities
Nothing in these terms and conditions is to be interpreted as a waiver of any privileges or immunities accorded to EFI by its constituent documents or international law.
